Changes in industrial safety regulation of Russian Federation from 21.10.2011 according to Federal Law No. 248-FZ

PROMTECH-Group brings to your attention a number of changes an amendments in legislative acts connected with industrial safety, deriving from the Federal law No.248-FZ "On introduction of changes in certain legislative acts of Russian Federation by realization of Federal law "On technical regulation", which came into force on the 21st of October 2011. According to article 24 of Federal law No.248-FZ these changes relate to article 7 of Federal law No. 116-FZ "On Indutrial Safety of Hazarous Industrial Facilities" from 21st of July 1997.

According to these changes, if technical devices, used in hazardous industrial facilities, are compliant with the Technical Regulations (TR), then "Permit to use" from RosTechNadzor is not required, in-so-much as only obligatory certification and declaration on conformity are the stated criteria of conformity in the TR. At the same time, RosTechNadzor will continue to issue "Permits to use", since not all Technical Regulations have yet come into force.

At present, the following technical regulations, that establish mandatory requirements for the technical devices, are approved:

  1. Technical regulation No 753 "On safety of machinery an equipment", approved by the Government of the Russian Federation on 15th of September 2009 (in force)
  2. Technical regulation No 783 "On safety of elevators", approved by the Government of the Russian Federation on 2nd of October 2009 (in force)
  3. Technical regulation No 720 "On safety of wheeled vehicles", approved by the Government of the Russian Federation on 10th of September 2009 (in force)
  4. Technical regulation No 620 "On maritime safety facilities", approved by the Government of the Russian Federation on 12th of August 2010 (in force)
  5. Technical regulation No 870 "On safety of distribution and consumption nets", approved by the Government of the Russian Federation on 29th of October 2010 (in force)
  6. Technical regulation No 86 "On safety of equipment used in explosion-hazardous environments", approved by the Government of the Russian Federation on 18th of October 2011 (effective from 15th of February 2013)
  7. Technical regulation No 623 "On safety of inland waterway transport facilities", approved by the Government of the Russian Federation on 12th of August 2010 (effective from 23rd of February 2012)
  8. Technical regulation of the Customs Union No 768 "On safety of low voltage equipment", approved by the Commission of the Customs Union on 16th of August 2011 (effective from 1st of July 2012)

The direct applicability of these new regulations is nevertheless based on several other factors (for example the local RTN or the final customer). Therefor we recommend you to clarify the situation for each project individually.
